Manhattan judge orders Ed Sheeran to face Marvin Gaye “Let’s Get It On” plagiarism lawsuit

    Ed Sheeran is ordered to face plagiarism charges files against him from the right holders of 1973 classic “Let’s Get It On” by Marvin Gaye.

    As ruled by US District Judge Louis Stanton in Manhattan: “The overlap of the protectable elements alone prevents a judgment of non-infringement as a matter of law.”

    In this jurisdiction, the Manhattan court denies, on Thursday, January 3, the request of Ed Sheeran to dismiss the lawsuit against the 2014 hit single “Thinking Out Loud” stating that a jury should decide about Sheeran’s liability over the copyright of the song’s associated music companies.

    “Although the two compositions are not identical, an average lay observer could conclude that parts of TOL were appropriated from LGO,… Even applying the ‘more discerning’ analysis for works that have both protectable and unprotectable elements, the overlap of the protectable elements alone prevents a judgment of noninfringement as a matter of law,” Stanton added.

    The lawsuit which Ed Sheeran is facing was brought by Structured Asset Sales LLC that costs $100 million for damages done.
